Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Brewin mobile application (“App”) operated by Brewin (“we,” “our,” or “us”). By creating an account or using the App, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines.

If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 12 years old to use Brewin. If you are between 12 and 18 years old (or the age of majority in your jurisdiction), you may only use the App with the consent of a parent or legal guardian, and that parent or guardian must agree to these Terms on your behalf.

In the European Union, you must be at least 16 years old to create an account, or have verifiable parental consent, in accordance with the GDPR.

3. Your Account

3.1 Account Creation

You must create an account to use Brewin. You can register using an email address and password, or through a third-party sign-in provider (Apple or Google). You agree to provide accurate, current, and complete information during registration and to update it as needed.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at info@brewin.coffee if you suspect unauthorized access to your account.

3.3 Account Deletion by You

You may delete your account at any time through the App's settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

3.4 Account Suspension or Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or our Community Guidelines, engaged in abusive behavior, or if required by law.

4. User-Generated Content

4.1 What Is User-Generated Content

“User Content” means any text, photographs, images, ratings, reviews, brew notes, and other materials you post, upload, or share through the App, including on the Brewin feed and in your public profile.

4.2 Your Ownership

You retain ownership of the User Content you create. We do not claim ownership of your photos, posts, or brew notes.

4.3 License You Grant to Brewin

By posting User Content on Brewin, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, display, reproduce, distribute, and modify your User Content solely for the purposes of operating, promoting, and improving the App.

This license continues for as long as your User Content remains on the App. If you delete a post or your account, this license ends for that content, except where your content has been shared by other users or where copies persist in backups for a reasonable period.

4.4 Public Nature of Content

All User Content posted to the Brewin feed, your profile, and your coffee library is publicly visible to all Brewin users. There are no private account or private post options at this time.

4.5 Content Rules

You agree that you will not post User Content that:

  • Is illegal, fraudulent, or violates any applicable law or regulation
  • Infringes on the intellectual property, privacy, or other rights of any third party
  • Contains sexually explicit, pornographic, or obscene material
  • Promotes violence, hatred, discrimination, or harassment against any individual or group
  • Contains threats, bullying, or intimidation directed at any person
  • Is spam, unsolicited advertising, or commercial solicitation
  • Contains malware, viruses, or harmful code
  • Impersonates another person or entity, or misrepresents your affiliation
  • Contains personal or private information of another person without their consent
  • Is intentionally false or misleading

4.6 Content Moderation

We reserve the right, but are not obligated, to review, monitor, and remove User Content that violates these Terms or our Community Guidelines. You may report content using the report feature within the App. You may also block other users at any time through their profile.

4.7 No Responsibility for User Content

We do not endorse, verify, or guarantee the accuracy, completeness, or usefulness of any User Content. You understand that by using the App, you may encounter content that you find offensive or objectionable, and you use the App at your own risk in this regard.

5. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the App, other user accounts, or our systems
  • Use the App to collect, harvest, or scrape user data or content without authorization
  • Interfere with or disrupt the App's infrastructure or other users' use of the App
  • Use automated means (bots, scrapers, crawlers) to access the App without prior written consent
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use the App to distribute unsolicited messages or spam
  • Create multiple accounts for deceptive or abusive purposes

6. Intellectual Property

6.1 Our Property

The App, including its design, code, features, logos, trademarks, and coffee database content, is owned by Brewin and protected by intellectual property laws.

6.2 Coffee Database

The coffee information in our database is proprietary to Brewin. You may not copy, scrape, reproduce, or redistribute this data without our prior written permission.

6.3 Feedback

If you provide us with suggestions, ideas, or feedback about the App, you grant us the right to use that feedback for any purpose without compensation or attribution to you.

7. Copyright Infringement and DMCA

We respect the intellectual property rights of others. If you believe that content on the App infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent at info@brewin.coffee.

8. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or completely secure.

Information in our coffee database (tasting notes, origin details, ratings) is provided for informational and entertainment purposes only. We do not provide dietary, medical, or allergy advice.

Brew timers, ratios, and other guidance within the App are suggestions based on common practices. Results may vary.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BREWIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL.

Our total liability to you for all claims shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty US dollars ($50.00), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Brewin and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or related to your use of the App, your User Content, your violation of these Terms, or your violation of any rights of another person or entity.

11. Third-Party Services

The App uses third-party services (such as Firebase and Apple/Google sign-in) that are subject to their own terms and privacy policies. We are not responsible for the practices of these third parties.

12. App Store Provisions

You acknowledge that these Terms are between you and Brewin, and not with any app store provider. Brewin, not the app store, is solely responsible for the App, including its content, maintenance, support services, and warranty.

13. Modifications

We may modify, update, or discontinue any features of the App at any time without prior notice. We may update these Terms from time to time. If we make material changes, we will notify you through the App or via email. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

14. Governing Law & Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States. Before filing any formal legal proceeding, you agree to first attempt to resolve any dispute through good-faith informal negotiation by contacting us at info@brewin.coffee.

If we cannot resolve a dispute informally, you and Brewin agree that any dispute shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) in Cook County, Illinois.

YOU AND BREWIN AGREE THAT EACH PARTY MAY ONLY BRING CLAIMS AGAINST THE OTHER IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Brewin regarding your use of the App.
